Terms of Service

These Terms of Service ("Terms") govern your access to and use of gettessen.com (the "Site") and the Tessen macOS application ("Software", together with the Site, the "Service"), provided by Tessen Software ("Tessen", "we", "us"). By downloading, installing, or using the Software, or by using the Site, you agree to these Terms. If you do not agree, do not use the Service.

The software licence itself — what you may and may not do with the installed application — is set out in the End-User Licence Agreement (EULA), which is incorporated into these Terms by reference. Where the EULA and these Terms overlap on software use, the EULA controls.

1. Eligibility

You must be at least 16 years old, or the age of digital consent in your jurisdiction if higher, and have the legal capacity to enter into a binding contract, to use the Service.

2. The Service

Tessen is a macOS application that performs speech-to-text dictation and related text formatting entirely on the user's own device. The Site offers information about the Software, an email notification signup, and a checkout flow operated by Stripe.

3. Accounts

Tessen does not require you to create an account to dictate. A licence is tied to the email address used at purchase and a licence key generated at that time; you are responsible for keeping your licence key confidential and for all activity that occurs using it.

4. Free trial and free tier

New users may access a time-limited free trial of Tessen Pro, currently 14 days, with full feature access and no credit card required to start it. No payment method is collected to begin a trial, so you will not be charged when it ends.

When the trial ends, dictation does not stop. Tessen falls through to a permanent free tier: 2,000 words of dictation per rolling 7-day period, at no charge, for as long as you use the Software. Once you use your free words for the week, dictation pauses until the 7-day window rolls forward and your word budget resets on its own — no action is required from you. To dictate without that weekly limit, purchase a subscription at any time.

We may change the length of the free trial, or the word or period limits of the free tier, at any time, including for future users.

5. Subscriptions, billing, and renewal

Tessen Pro is offered on a monthly ($9/mo) or annual ($69/yr) subscription basis, billed in advance through Stripe. Prices are shown at checkout and may change with notice as described in Section 12; a price change will not affect a billing period you have already paid for.

6. Cancellation

You may cancel your subscription at any time by emailing [email protected] from the address you paid with. That is the route we guarantee, and we will confirm the cancellation to you in writing within one business day. If your receipt from Stripe happens to carry a subscription-management link, you may use that instead — but do not rely on one being there, and email us if it is not.

Cancellation stops future renewal; it does not, by itself, refund the current billing period — see our Refund Policy for that. Access to Pro features continues until the end of the period you already paid for.

Refunds are governed by our Refund Policy, including the statutory withdrawal right available to EU/UK consumers.

The Software, the Site, and all associated trademarks, logos, and content are owned by Tessen Software or its licensors. These Terms grant you no rights to our intellectual property except the limited licence to use the Software described in the EULA.

10. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT TRANSCRIPTION WILL BE ERROR-FREE OR THAT THE SOFTWARE WILL MEET YOUR SPECIFIC REQUIREMENTS. Nothing in this section limits any statutory rights you have as a consumer that cannot lawfully be excluded, including statutory rights under EU/UK consumer protection law.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL Tessen Software BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

12. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above and, where practical, notify active subscribers by email before the change takes effect for them. Continued use of the Service after a change takes effect constitutes acceptance of the revised Terms.

13. Termination

We may suspend or terminate your access to the Service if you materially breach these Terms or the EULA. You may stop using the Service, and cancel any subscription, at any time.

14. Governing law

These Terms are governed by the laws of the laws of England and Wales, without regard to conflict-of-law principles, and without prejudice to any mandatory consumer-protection law of the country in which you reside.

15. Miscellaneous

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect. These Terms, together with the EULA and the Privacy Policy, constitute the entire agreement between you and us regarding the Service.
